17 Mar Texas Family Sues For Medical Malpractice Over Death of Son
The family of a Dallas child who died as a result of alleged gross medical negligence is currently in the throes of a legal battle with a children’s medical center which allegedly failed to treat the child in a timely manner. Roberto Llanas Jr. was taken to hospital after he collided with a pole at his school’s playground. He was treated and released shortly after. However, he died a few hours later due to a lacerated kidney and internal hemorrhage.
Medical Malpractice Lawsuits Are Capped
The suit names the attending physician and the hospital as the defendants. Medical malpractice lawsuits in Texas are unfairly capped at $250,000 thanks to tort reform legislation. Having said that, the hospital is refusing to pay this amount, stating that it should be much lower. Les Weisbrod, a local attorney representing the family says that the hospital is denying all accusations of gross negligence even when the evidence point to the opposite being true.
New Legislation
These kinds of cases are unfortunately common in Texas. About a decade ago, new legislation was enacted to stop the "mass migration" of doctors from the Lone Star State. Insurance company lobbiests were able to convinve the votimg public that if all medical malpractice lawsuits were capped at $250,000, we would see less frivilous cases. Of course that clearly doesn't stop cases from being brought, it simply limits the liability of the insurance company when theres a case involving permanent injury or death. A cap of $250,000 is a slap in the face to those who have lost a family member to malpractice.
Money Isn’t Our Main Motivation
Parents of the late Roberto Llanas Jr. insist that this lawsuit isn’t motivated purely by money and that they want to raise awareness and seek justice for their boy. They also stated that they trusted the doctor who treated their son and that they did not live up to their word. Their main aim is to hold the hospital responsible for the death of their son and that misdiagnosis should not play a part in such situations.
