Manufacturing Flaws and Defective Products

One of the ways in which a product may be found to be defective is in terms of its manufacturing. In cases where people sue over defective products, they’re usually suing over the advertising, design or manufacturing processes involved in getting that product on the market. Sometimes, companies have good designs and they advertise the products honestly but, in the end, their manufacturing processes end up being so flawed that the product poses a genuine danger to the people who purchase it.

Lemons

Probably the most common example of a product that is manufactured in a defective way is a bad vehicle. Most of the time, cars that are manufactured poorly are called lemons. These are vehicles that have flaws in them that are either dangerous or that render the vehicle unreliable. In the best case scenario, the manufacturer will discover that there is a flaw in their vehicle and they will recall them immediately. In these instances, the vehicle is usually repaired at no cost to the consumer and, after the issue is resolved, the product is completely serviceable. There are cases, however, where manufacturing flaws are not discovered until somebody gets hurt.

An example of a flawed manufacturing process could be found in the lead paint contaminated baby toys that were shipped to the US from China. The design of the toys may have been fine and the packaging may have not been misleading in any way. The danger stems from the fact that they were contaminated with a substance that’s known to cause cancer and other damage to the body and that people were sold it without knowing that they were putting their child at risk. Even a product that is inherently dangerous, such as a firearm, can be manufactured in a way that makes it even more dangerous when used exactly as it’s intended to be used.

A defective product attorney will want to sit down with you and discuss your situation if you believe that you have good cause to file a lawsuit against a company over a defective product. Product liability lawyers in Texas have to be able to determine whether or not the product was manufactured in a way that made it dangerous, marketed in a way that made it dangerous or designed in a way that made it dangerous. If any of those problems apply, there is a chance that you could file a lawsuit and get compensated for your losses.
