25 Mar GM Recall Linked to 300+ Car Accident Wrongful Deaths
GM has recently come under fire, and lots of people aren’t happy. This is in response to a recall in January which involved millions of cars.
These cars have a defect which makes ignition keys come loose while an individual is on the road, causing crashes and death due to the inability of airbags to deploy.
Class Action Suit
Lawyers over here who are representing the plaintiffs, Daryl and Maria Brandt of Neuces County, Texas are looking to consolidate all cases into a class action suit given the number of vehicles affected. At the same time, the National Highway Traffic Administration as well as GM are both carrying out investigations to determine the exact cause of these defects. Other bodies involved in this case include the Justice Department, a House subcommittee and the Transportation department.
It’s alleged that this defect has a long history dating back to 2001, meaning that there might have been many more people who were injured or died as a result of it than is known. As far as General Motors is concerned, only 13 people have died because of the ignition slot and airbag deployment mechanism defect. However, U.S. safety regulators have put this number to about 303 and counting. Accident records by the National Highway Traffic Safety Administration’s Fatal Analysis Reporting System paint a different picture.
Shirking Responsibility
GM is looking to absolve itself from any responsibility by claiming that the company which manufactured these defective cars doesn’t exist anymore due to the bailout in 2009, resulting in a restructuring and formation of a new business entity. However, attorneys representing the plaintiffs are of the opinion that GM should face charges brought against them if it can be proven that they knew about the defect and didn’t say anything about it.
The NHTSA also should have investigated why Cobalt airbags weren’t deploying in increasing numbers a few years back. This would have saved lives and helped GM look into their manufacturing practices.
