Nursing Home Workers Sometimes Assert Senior Rights

Three recent wrongful termination lawsuits filed in Michigan detail how the employees at a nursing home sometimes end up being the ones to assert the rights of senior citizens and other patients.

In one case, an employee filed a wrongful termination lawsuit because she was assigned to a patient that she knew she would not be able to provide adequate care for. The nurse had injured her wrist and had a limitation on how much weight she was supposed to lift. She told management that she could adequately care for the patient to which she had been assigned and, eventually, that resident did end up falling. The nurse told this to a state investigator and that she was told not to write up a report about the incident and, the next day, the nurse was fired, leading to the lawsuit.

In an even more disturbing incident, an employee said that she was fired from the facility because she had reported unsanitary conditions at the facility. In this case, a resident who was fitted with a catheter was not provided with proper hygienic services and, eventually, the resident suffered an infestation of maggots in her genitals. There were other incidents reported, as well, and the issues have been reported to have been rectified, but the woman who made the report lost her job and filed a wrongful termination lawsuit, as well.

Asserting Rights

In some cases where nursing home abuse is an issue, it may not actually be the nursing staff that is to blame. In fact, they are sometimes the only people who try to stand up for the rights of senior abuse victims in nursing homes. Some nursing homes vastly understaff the facility, forcing nurses to take care of many more patients than they are physically able to. In other cases, the administration may try to cut corners and cut costs by neglecting patient care.

If it seems like the nursing home staff is overworked and that the facility itself is understaffed, this is a major cause for worry.
