Social Security Disability Benefits Appeal Process

The Social Security Administration allows for an appeals process to help ensure you receive the disability benefits you deserve. If you feel you qualify for Social Security or Supplemental Security Income, you can appeal a denied claim.

Legal Representation for a Social Security Disability Appeal

Whether or not the SSA decides you are eligible for benefits, they will send you a letter explaining the decision. If you feel you deserve benefits, but were denied, you can ask for an appeal. When you file for an appeal, you are entitled to legal representation to help ensure you receive all the benefits you deserve.

It's wise to seek legal counsel when you file an appeal. When you file an appeal, the SSA reviews your entire case, even the items that were in your favor to begin with. If you are not prepared, the appeal might turn out even worse than your original application for disability benefits.

Some people handle their own Social Security appeals although we recommend against this. Although the Social Security Administration provides some help, the process can be very confusing. You have the right to choose a lawyer, a friend or someone else to help you. This appointed person is called a "representative." The SSA will work with your representative just as they would work with you.

How to Appeal A Denied Social Security Disability Claim

If you wish to file an appeal, you or your representative must make a request for an appeal in writing within sixty days from the date that the negative decision letter is received. The SSA assumes you received the letter five days after the date on it, unless you or your representative can prove you received it later.

Levels of Appeal

The SSA provides for three levels of appeal. The first level is a hearing by an administrative law judge, the second, a review by the appeals council, and the third level of appeal consists of a federal court review.
