I Was Just In an Auto Accident? Now What?

9/26/08

There are several different types of insurance coverage that might be relevant after your car wreck.

1)Your personal auto policies: You may be covered by your insurance even when the accident isn't your fault or when you were a passenger in another vehicle. You should examine your policy before you call your insurance company to file a claim. The following are types of coverage you may be eligible for.

-Medical Payments

-Collision

-Rental reimbursement

-Uninsured motorist coverage

2) The Auto Policy Covering the Vehicle in Which You Were a Passenger: You are entitled to the benefits that cover that vehicle.

-liability coverage: If the driver of the vehicle you are riding in is at fault, the liability coverage would be responsible for compensating you for your damages.

-Medical Payments/Uninsured Motorist: You are entitled to the same benefits as the policy holder.

3)At-Fault Driver's Auto Liability Policy: The insurance covering the at-fault driver/vehicle will be responsible for the damages that were sustained as a result of the accident. These would be either:

-property damage
-bodily injury

4) Your Health Insurance Policy: If you have had a health insurance plan at the time of the accident, this will pay for your medical expenses while you are under medical treatment. This will kick in as soon as the Med-Pay coverage has been spent.

5) Disability policy: If you are unable to return to work after an accident, you will be able to make a claim for disability under any disability policies you had at the time of the accident.

6) Worker's Compensation: If you were involved in an accident on the job, your employer will be able to extend benefits through the worker's compensation plan to cover bills and loss of earnings. It is crucial that you speak with an attorney as soon as you can in these situations. Managing benefits between all insurance policies is an area that requires very specialized legal knowledge.
